GDPR Privacy Policy

We, Santec Corporation, take protection of personal data of data subjects in the European Economic Area (“EEA”) under the terms and conditions set forth in the General Privacy Policy which comply with Act on the Protection of Personal Information in Japan (please click here) and this Privacy Policy which comply with the REGULATION OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive “95/46/EC” (“GDPR”) and other relevant laws and regulations. If there is any discrepancy or inconsistencies between the General Privacy Policy and this GDPR Privacy Policy, this GDPR Privacy Policy shall prevail.

Compliance with Laws

We comply with the applicable laws and regulations for the protection of personal data.  All personal data collected by us will be used for the purposes set forth herein only.

Purpose of Use and Legal Grounds of Collection and Process

We collect and process the personal data of our shareholders, customers, job applicants and patients as follows:

(1) Shareholders
We collect and process shareholders’ personal data (name, address, phone number and email address) only for the purposes set forth below:

  • Performance of our obligations under the applicable laws and regulations and/or contracts with shareholders; and,
  • Notification in connection with the above performance.

Collection and processing of shareholder’s personal data shall be lawful on the grounds that (i) processing is necessary for compliance with a legal obligation to which we are subject, (ii) processing is necessary for the purposes of the legitimate interests pursued by us, or (iii) the shareholders have given consent to the processing of personal data..

(2) Customers
We collect and process customers’ personal data (name, company name, address, phone number and email address) only for the purposes set forth below:

  • Contact through phone, e-mail, post, facsimile, etc. in connection with transactions, discussions, customer’s inquiries, etc.;
  • Process of order, delivery, claim, payment and any other transactional matters;
  • Notification through phone, e-mail, post, facsimile, etc. of information of our marketing activities including but not limited to information of events and/or products provided by us, our subsidiaries, affiliates or partners;
  • Implementation of customer satisfaction surveys for products and/or services provided by us, our subsidiaries, affiliates or partners; and,
  • Implementation of market analysis.

Collection and processing of customer’s personal data shall be lawful on the grounds that (i) processing is necessary for the performance of a contract to which the customer is a party or in order to take steps at the request of the customer to entering into a contract, (ii) processing is necessary for the purposes of the legitimate interests pursued by us, or (iii) the customers have given consent to the processing of personal data.

(3) Job Applicants
We collect and process job applicants’ personal data (name, address, school or working place, phone number, email address and any personal data stated in your CV) only for the purposes set forth below:

  • Provision of information for job applicants and performance of works in connection with our recruiting activities.

Collection and processing of job applicant’s personal data shall be lawful on the grounds that (i) processing is necessary for the purposes of the legitimate interests pursued by us, or (ii) the job applicants have given consent to the processing of personal data.

(4) Patients
We collect and process patients’ personal data (name, birth date, sex and eye parameters and physician’s comments for eye parameters) only for the purposes set forth below:

  • Ensuring high standards of quality and safety of our medical products or medical devices.

Collection and processing of patients’ personal data shall be lawful on the grounds that (i) processing is necessary for reasons of public interest in the area of public health, on the basis of applicable laws and regulations which provide for suitable and specific measures to safeguard the rights and freedoms of the patients, in particular professional secrecy; or, (ii) the patients have given consent to the processing of personal data.

Provision and Share of Personal Data

We may share your personal data to the following third parties for the purposes of use set forth in the above on the condition that we and such third parties shall comply with the applicable laws and regulations with respect to protection of personal data:

  • Santec Group Companies (Santec Europe Ltd, Santec USA Corporation and Santec (Shanghai) Corporation Limited.);
  • External Specialists who are bound by confidentiality obligations under the relevant laws and regulations such as lawyer or tax accountant;
  • Our employees and employee of our group companies.

Use of Processor

We may outsource the process of your personal data to customer relationship management service providers and/or any other processors.  In such a case, we use only processors providing sufficient guarantees to implement appropriate technical and organizational measures in such a manner that processing will meet the requirements of the applicable laws and regulations and ensure the protection of your rights.

Transfer to Third Countries

No Statutory or Contractual Requirement

Unless otherwise agreed between us and you, the provision of your personal data is neither statutory requirement nor contractual requirement and you will not suffer any disadvantages from non-provision of your personal data.

Automate Processing

Your personal data will not be used through automated decision-making process including profiling.

Personal Data of Person under 16 years old
